Insurance - COI added as additional insured

Acknowledgment: I understand and acknowledge that the activity to be engaged in through my rental of an interactive amusement game(s) and/or other amusement equipment brings with it both known and unanticipated risks to my guests, my invitees and myself. Those risks include, but are not limited to falling, slipping, crashing and colliding and could result in injury, illness, disease, emotional distress, death and/or property damage to myself or my guests and invitees. 

I voluntarily release, indemnify, hold harmless and discharge lessor, including its agents, servants, employees, officers, directors, and/or shareholders, from any and all liability, claims, demands, actions or rights of actions, whether personal to me or to a third party which are related to, arise out of or are in any way connected with my rental of the interactive inflatable unit including those allegedly attributable to negligent acts or omissions. I agree to reimburse any reasonable attorney’s fees and costs which may be incurred by Lessor in the defense of any such liability claim, demand, action or right of action.

In the event that I file a cause of action against Lessor, I agree to do so solely in the state of AZ and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

-I acknowledge that I have adequate homeowner’s insurance, tenant insurance, or other liability insurance to cover any bodily injury or property damage that might occur to myself, my guests, or my invitees from the use of the unit I am renting or else I agree to bear the costs of such injury or damage myself. Lessee warrants and represents that he, she or it will, at all times, supervise the safe use and operation of the property leased herein.

-I acknowledge and certify that I have had sufficient opportunity to read this entire document, that I understand its content and that I execute it freely, intelligently and without duress of any kind and agree to be bound by its terms. By replying to this notice/form I agree with these terms. 

Agreement:

I agree that I am at least 18 years of age and ultimately responsible for all the rental items listed in this agreement until picked up by Lessor.  I acknowledge that I have the adequate homeowner's insurance, tenant insurance or other liability insurance to cover any bodily injury or property damage which might occur to myself, my guests or any other person as a result of the use of the rental items. I agree to bear all costs for rental equipment that is stolen, lost and /or damaged and I am required to replace and/or repair the equipment rented and subsequently it will remain the property of Bounce then slide LLC.  I will have an adult supervise the rental unit and its use at all times. I agree that I may be charged up to $45 per hour cleaning fee for any food, drinks or silly string. I agree that I may be charged minimum $80 per hour for cleaning of pet droppings or any other foreign substance on the rental item(s) OR I may be charged full replacement cost of inflatable if equipment owner does not want to clean it.   I voluntarily release Bounce then Slide LLC, including its agents, servants, employees, officers, directors, partners, affiliates, independent contractors, and/or shareholders from any/all liability and agree to reimburse any attorney’s fees and costs which may be incurred by either company in defense of any such liability claim, demand, action, etc.  I have inspected the unit(s) and acknowledge that it/they is/are in good and safe working order. Damage insurance is not liability insurance. If you paid extra for the Inflatable damage insurance it does not cover vandalism, theft, negligence, or any damage caused from failure to follow all safety rules. Bounce Then Slide LLC has the right to share any information we collect from you with our affiliates as needed to fulfill your order or for any liability purposes. Bounce Then Slide can cancel your order, delivery, reservation, and or contract at any time.
